Our representative experience includes:

  • Obtained summary judgment on negligence and premises liability claims valued at over $1 million for large convenience store chain sued by a customer who was shot on their property. Judgment was affirmed on appeal.  
  • Obtained substantial, and ultimately non-dischargeable, judgment for motor vehicle dealership client against former employee and her spouse after they embezzled from the company, absconded with the proceeds to Oklahoma, and filed bankruptcy; recovered and liquidated a substantial amount of the debtors’ assets after obtaining a court order declaring that the property belonged to client and not the debtor’s bankruptcy estate.  
  • Obtained summary judgment on behalf of secured lender against competing lender’s claims for declaratory judgment, breach of contract, and breach of fiduciary duty arising out of complex financing transaction that exceeded $50 million in value.  
  • Obtained order granting summary judgment to property developer embroiled in premises liability and Dram Shop action. Upheld on appeal.
  • Obtained agreed judgment absolving doctor of all liability in case brought by former patient raising claims of Deceptive Trade Practices and fraud.  
  • Obtained summary judgment against product vendor for breach of UCC contract on behalf of foreign manufacturing client resulting in a substantial judgment for client.
  • Appealed order denying state hospital workers immunity in highly publicized civil rights case, and obtained rendered judgment for workers.  
  • Prosecuted payment technology company’s claims for trade secret misappropriation, cybercrimes, and related torts while defending company against claims of trade secret misappropriation and patent infringement filed by competitor.  
  • Defended auto-body repair company against claims of trade secret misappropriation, breach of fiduciary duty, and other business torts, resulting in settlement of action for roughly 10% of competitor’s opening demand.  
  • Secured the assets of, and an advantageous settlement for, a secured lender and real property owner in an action filed against company taking raw materials from lender’s land.
  • Represented landlord in dispute involving commercial lease of multi-million dollar property. 
  • Pursuing strategic partnership and licensing agreements with flat panel display (FPD) related technology companies, as well as telecommunications and internet appliance related partners including telecommunications carriers (traditional, broadband, and wireless), portals, web and non-web based content partners, and product/service suppliers.
  • Represented the City of Dallas and the Chief of Police of the Dallas Police Department in an appeal before the U.S. Court of Appeals for the Fifth Circuit that affirmed the trial court’s award of summary judgment.
  • Obtained summary judgment in favor of the City of Dallas on age, gender and race discrimination under Title VII, ADEA, 42 U.S.C. § 1983, and the Texas Commission on Human Rights Act.
  • Obtained summary judgment in favor of Fortune 500® company on race discrimination, hostile work environment and retaliation claims under Title VII.
  • Obtained summary judgment in favor of Fortune 500® company on FMLA retaliation claim.
  • Part of trial team that obtained “take nothing” judgment in defense of race, age and national origin discrimination claims against Fortune 500® company and individuals under Title VII and the Texas Commission on Human Rights Act.
  • Assisted with defense of multi-million dollar government contractor, company officers, and employees in debarment proceedings initiated by the Department of Labor, Wage and Hour Division.
  • Obtained dismissal of claims asserted under the Americans with Disabilities Act on behalf of a national hotel franchisor in the Eastern District of Texas.
  • Assisted with defense of financial institution in proceedings initiated by the Department of Labor, Office of Federal Contract Compliance Programs Division.
  • Obtained a take nothing jury verdict on behalf of public hospital in Texas Whistleblower Act action brought by former employee.
  • Obtained summary judgment on behalf of public hospital in defense of Title VII race discrimination and retaliation claims.
  • Obtained voluntary dismissal of three of four claims, and summary judgment and award of costs on sole remaining claim in favor of public employer alleging retaliation under Title VII.
  • Obtained a nuisance-value settlement on behalf of employer on the eve of trial in suit alleging claims of race discrimination and retaliation in violation of Title VII.
  • Obtained summary judgment on behalf of Fortune 500® company in defense of discrimination and retaliation claims under Title VII.
  • Assisted trial team in obtaining a take nothing judgment and award of attorney’s fees on behalf of a Fortune 500® company in a suit alleging race, age, and national origin discrimination and retaliation under the Texas Labor Code.
  • Successfully resolved suit brought against a national retailer alleging violations of the FLSA and discrimination under Title VII.Obtained a favorable settlement on behalf of restaurant franchisor and related entities in suit alleging violations of the FLSA
  • Representation of global financial services company in patent infringement case in the Eastern District of Texas and appellate proceedings in the Federal Circuit.
  • Representation of major telecommunications and wireless device manufacturer in patent infringement suit involving data transmission in the Northern District of Texas.
  • Representation of German software company in cancellation proceedings before the Trademark Trial and Appeal Board.
  • Represented a Fortune 500® semiconductor manufacturer in patent licensing, litigation, infringement and invalidity analysis, as well as patent preparation and prosecution, including reexamination.
